FIFTH ORDER OF BUSINESS Old Business

A. Discussion on New O&M Assessment Methodology

i. DTA Public Finance Proposal Follow-up

District Manager Gindling reported that DTA provided an additional example report from the City of Delray Beach and confirmed that the firm does not have examples of assessment studies prepared for Florida CDDs, as its work has primarily been performed for cities within Florida and other areas of the country.

The Board reviewed the sample report and noted that it included several methodologies, including stormwater runoff coefficients, impervious and non-impervious surface calculations, and five different methods for analyzing the same data.

Attorney Williams suggested that the Board would benefit from a discussion with DTA regarding its methodologies, the factors considered in its analyses, and the reasoning behind its approach.

Following discussion, the Board requested Staff reach out to DTA and request they attend a future meeting to answer questions regarding its methodology and approach, and Supervisor Pattee agreed to contact Hector from DTA to discuss the matter further.

B. Lakes 10 and 18 Shoreline Restoration Follow-up

i. Contract Negotiation Follow-up

District Manager Gindling reported that contract negotiations with Talon Construction remain in progress following the Board’s authorization at the previous meeting for Attorney Williams to prepare a contract. Ms. Gindling also stated that Talon has been notified that it was selected for the shoreline restoration project.

Attorney Williams explained that the contract will include a detailed scope of work, a maximum project cost, warranty provisions, and a requirement that all change orders be submitted and approved in writing. The Board discussed responsibility for restoring landscaping and repairing any damage associated with construction access, and counsel advised that such work should be the responsibility of the contractor, which is also required to maintain appropriate insurance coverage.

The Board requested that photographs be taken of all proposed access areas before work begins to document existing conditions and ensure the areas are restored upon completion of the project. It was further noted that delays to the Triana painting project are expected to reduce potential scheduling conflicts for the shoreline restoration work.

ii. Staging and Access Areas

Field Manager Pepin reported that an additional access point at the west end of Lake 18 may be available for the shoreline restoration project; however, shrubs adjacent to a nearby building would need to be removed to accommodate access. The Board expressed concerns regarding the adequacy of the available space and discussed alternative access locations, including an area between homes, the maintenance shed area, and Renaissance Way.

The Board requested that an on-site meeting be held with project representatives before construction begins to review the project schedule and determine the most appropriate access locations. The Board also emphasized minimizing the number of access points used during construction to reduce the amount of site restoration required upon project completion.

C. Hurricane Cleanup Pre-authorization Form from Juniper

The Board declined to proceed with Juniper’s hurricane cleanup pre-authorization form, noting that similar forms from two other vendors had already been approved.

D. SFWMD Notice of Noncompliance Update

District Manager Gindling reported that the District is awaiting a follow-up inspection from the SFWMD regarding the preserve. No further updates have been received at this time.

E. RCA Request for Parking Spots for Guardhouse Employees

District Manager Gindling reported that the easement dedications and plat information related to the proposed guardhouse employee parking area had been provided to resident Paul Halverson.

Attorney Williams is also reviewing District records to determine whether any additional easements exist that may be applicable to the project.

SIXTH ORDER OF BUSINESS New Business

A. Insurance Renewal Quotes

District Manager Gindling reviewed the District’s insurance renewal options. Egis submitted a renewal quote, while Brown & Brown provided a preliminary estimate based on prior-year property values. The Egis proposal reflected increased property coverage and premiums due to updated appraisals, particularly for the perimeter walls, which were valued higher than in previous years.

Following discussion of the insurance renewal proposals, the Board requested additional information regarding increased public officials liability coverage and unlimited defense coverage. Chair Dickey was authorized to approve the selected proposal between meetings, with ratification to occur at the October Board meeting.

B. Aeration Repair Quote

The Board reviewed the proposal from Fountain King in the amount of $1,800 to replace three non-functioning air stations on Lakes 8, 10, and 0-3.

On MOTION by Chair Dickey, seconded by Supervisor Epkins, with all in favor, the Board approved the Fountain King proposal to replace 3 air stations on Lakes 8, 10 & 0-3 in the amount of $1,800.

C. Upcoming Board Vacancies

i. Letter of Interest from Ken Kunda

District Manager Gindling reported receiving one letter of interest from resident Ken Kunda and noted additional interest from resident Mark Harper. The Board discussed seeking further resident interest before making an appointment and agreed to consider potential candidates for the upcoming Board vacancy at the November meeting.

D. FY 2026 Audit Engagement Letter

District Manager Gindling reviewed the audit engagement letter submitted by Berger, Toombs for the District’s FY 2026 annual audit services. Berger, Toombs also performed the FY 2025 audit.

A. Encroachment Agreement with 12450 Vittoria Way Update

Attorney Williams reported that he would follow up with the resident regarding the encroachment agreement and the disconnected drain pipe at the property.

B. Letter Regarding Grass Clippings in Lakes
